RMBEX is a Labuan-based financial services company that, among other things, operates: an OTC desk for foreign exchange and digital asset transactions; and the INFII Digital Finance platform and related payment / processing services. Information about these and any other RMBEX services on the Site is for general information and marketing purposes only. Actual products and services are provided subject to separate agreements, onboarding, risk assessments and regulatory requirements. Nothing on the Site constitutes: an offer, recommendation or solicitation to buy or sell any financial product; or financial, investment, legal, tax or other professional advice.

The Site is intended for users who are able to form legally binding contracts under applicable law. By using the Site, you represent that you meet this requirement. Access to specific RMBEX products or services (including OTC services and the INFII Digital Finance platform) may be restricted based on your jurisdiction, regulatory status, risk profile or onboarding outcome. The fact that the Site is accessible in a country does not mean all RMBEX services are available or permitted there. You agree to use the Site only for lawful purposes and in accordance with these Terms.

We may update or modify the Site, any content on it, and these Terms at any time, in our sole discretion. When we make changes, we will update the “Last updated” date above. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the changes, you should stop using the Site.

All information on the Site is provided on a general and informational basis only. It: does not take into account your particular objectives, financial situation or needs; and should not be relied on as financial, investment, legal, tax or other professional advice. Before making any decision involving RMBEX services, currencies, digital assets or cross-border transactions, you should obtain independent professional advice as appropriate.

Content on the Site does not constitute: an offer, invitation or solicitation to enter into any transaction, an invitation to apply for any product or service, or a recommendation to use any particular service. Any actual engagement with RMBEX (for example, using the OTC desk or INFII Digital Finance) will be governed by explicit agreements and terms provided to you during onboarding.

Some areas of the Site or related portals may require you to create an account or log in. You are responsible for: ensuring that any registration information is accurate and up to date; keeping your login credentials confidential; and all activities carried out under your account. If you believe your account has been compromised, you must notify us promptly at support@rmbex.asia. We may suspend or terminate access if we suspect unauthorised or abusive activity.

You must not: use the Site in any way that violates applicable laws or regulations; attempt to gain unauthorised access to any part of the Site, our systems or networks; probe, scan, or test the vulnerability of any system or breach security or authentication measures; introduce viruses, malware or other harmful code; use any robot, spider, scraper or other automated means to access the Site except as permitted by us; or copy, reproduce, modify, distribute or exploit any part of the Site except as allowed under these Terms or with our prior written consent. We may, at any time and without notice, suspend or terminate your access to the Site for conduct that we believe violates these Terms, our policies or applicable law.

Unless otherwise stated, all content on the Site – including text, graphics, logos, icons, images, videos, software and design – is owned by RMBEX or our licensors and is protected by copyright, trade mark and other intellectual property laws. You may view, download and print content from the Site for your own personal or internal business use only, provided you: do not modify the content; keep all copyright and proprietary notices intact; and do not use the content in a way that suggests endorsement by RMBEX without our prior written consent. Except as expressly permitted, you may not copy, reproduce, republish, upload, post, transmit, distribute, sell, license or create derivative works from any content on the Site without our prior written permission.

The Site may contain links to third-party websites, platforms or services that are not operated or controlled by RMBEX. We are not responsible for the content, security, privacy practices or availability of those third parties. Accessing any third-party site or service is at your own risk, and your use will be subject to their terms and policies. Any mention of a third party does not imply our endorsement, sponsorship or association with them.

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use and protect personal data. By using the Site, you acknowledge that we will handle your personal data in accordance with the Privacy Policy (as updated from time to time). The Site may use cookies or similar technologies. You can manage your cookie settings through your browser, but certain features may not function properly if cookies are disabled.

The Site and all content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, RMBEX and its directors, officers, employees and agents: do not make any guarantees, representations or warranties of any kind, express or implied, regarding the Site, including but not limited to accuracy, completeness, reliability, timeliness, non-infringement, merchantability or fitness for a particular purpose; and do not warrant that the Site will be uninterrupted, secure or free from errors, viruses or other harmful components. Information on the Site may be incomplete, outdated or subject to change at any time without notice.

To the fullest extent permitted by law, RMBEX and its directors, officers, employees and agents shall not be liable for any: loss of profits, revenue, business, goodwill or data; indirect, consequential, incidental, special or punitive damages; or losses arising from or in connection with: your use of, or inability to use, the Site; any reliance on information presented on the Site; any error, omission, interruption, defect, delay in operation or transmission; or any virus, system failure or other harmful component, even if we have been advised of the possibility of such damages. Where liability cannot be excluded under applicable law, our total aggregate liability to you arising out of or relating to the Site and these Terms shall, to the extent permitted, be limited to the amount of MYR 1,000 or such other minimum amount allowed by law.

You agree to indemnify, defend and hold harmless RMBEX and its directors, officers, employees and agents from and against any and all claims, losses, damages, liabilities, costs and expenses (including legal fees) arising out of or relating to: your use of or access to the Site; your breach of these Terms; or your violation of any law or the rights of any third party.

We may, at any time and without notice, suspend or terminate your access to the Site if: we reasonably believe you have breached these Terms; we are required to do so by law, regulation or a competent authority; or we discontinue the Site. Any provisions which by their nature should survive termination (including limitations of liability, indemnities and intellectual property provisions) will continue to apply.

These Terms and your use of the Site are governed by the laws of Labuan, Federal Territory of Labuan, Malaysia (without regard to conflict of law principles). You agree that the courts of Labuan (and, where applicable, the courts of Malaysia) shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or the Site.

If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted and the remaining provisions shall continue in full force and effect.

These Terms constitute the entire agreement between you and RMBEX in relation to your use of the Site and supersede any prior understandings or agreements relating to the Site.
